XTX Exclusive Partner Program Terms and Conditions
Version Date: October 19, 2026
These Terms & Conditions (“Agreement”) govern participation in the XTX Exclusive Partner Program (“Program”), operated by XTX Creative LLC, a Texas limited liability company doing business as XTX Creative (hereinafter referred to as “XTX Creative,” “Company,” “we,” “us,” or “our”).
By signing this Agreement, the participating individual or business (“Exclusive Partner”) agrees to be bound by the following provisions.
1. PROGRAM OVERVIEW
The XTX Exclusive Partner Program is an invitation-only initiative designed to establish professional referral relationships with individuals and businesses capable of introducing prospective clients to XTX Creative.
Exclusive Partners earn commissions by introducing new clients who enter into website development agreements with XTX Creative LLC.
The Program is limited to 12 active Exclusive Partners at any given time. Participation is selective and subject to approval by XTX Creative LLC.
The Program operates separately from the XTX Referral Program, which offers a lower commission rate without exclusive membership or activity requirements.
Exclusive Partners are not employees or subcontractors of XTX Creative LLC (see Section 10). Participation does not establish an employment relationship, strategic partnership, reciprocal referral arrangement, reseller relationship, subcontracting arrangement, or white-label service agreement.
2. DEFINITIONS
“Execution Date” means the date on which this Agreement has been signed by both the Exclusive Partner and XTX Creative LLC.
“Activity Period” means each consecutive six-month period beginning on the Execution Date. The first Activity Period begins on the Execution Date and ends on the day before the same calendar date six months later. Each following Activity Period begins on the day after the prior Activity Period ends.
“Introduction” means the Exclusive Partner’s written introduction of a prospective client to XTX Creative, made with the prospective client’s permission, either by an email that includes XTX Creative or through another referral method designated by XTX Creative. The date of the Introduction is the date XTX Creative receives it.
“Client Agreement” means a written agreement for website development services signed by both the prospective client and XTX Creative LLC.
“Initial Consultation” means a meeting, by phone, video, or in person, between XTX Creative and the prospective client’s owner or another authorized decision-maker to discuss a potential website development project.
“Qualified Introduction” means an eligible Introduction that satisfies Section 5.5. Qualified Introductions measure the activity requirement in Section 7.
“Successful Referral” means an Introduction that results in a Client Agreement in accordance with Section 5.3. Successful Referrals determine commissions.
“Website Development Fee” means the one-time fee charged under a Client Agreement for the design and development of the client’s website.
“Eligible Development Fees” means the portion of the Website Development Fee actually collected by XTX Creative LLC, subject to the exclusions in Section 4.1.
“Written notice” has the meaning given in Section 21.
3. PARTNER ELIGIBILITY & ENROLLMENT
Participation in the Program is by invitation only.
To become an active Exclusive Partner, an individual or business must:
- Receive and accept an invitation from XTX Creative LLC.
- Provide accurate contact, business, and payment information.
- Sign this Agreement.
- Conduct referral activities professionally, ethically, and in good faith.
- Comply with applicable federal, state, and local laws and regulations.
XTX Creative LLC reserves the right to approve or decline prospective Exclusive Partners at its discretion, consistent with applicable law.
Exclusive Partner status is nontransferable and may not be assigned to another individual or business without prior written authorization from the Company.
4. REFERRAL COMMISSION STRUCTURE
Exclusive Partners earn a commission equal to 20% of the Eligible Development Fees collected by XTX Creative LLC from each Successful Referral.
XTX Creative requires every client to have their website designed and developed by XTX Creative before receiving any marketing or ongoing services, and does not provide marketing services for websites it did not design and develop. Every new client therefore begins with a Client Agreement that includes a Website Development Fee. XTX Creative does not charge a separate onboarding fee.
XTX Creative LLC offers three website development classifications: Standard, Advanced, and Enterprise. Each classification has a starting price based on the anticipated scope, technical complexity, and development requirements of the project. Current starting fees and illustrative commissions are listed in Schedule A, which the Company may update from time to time without amending this Agreement.
Actual website development fees may be higher or lower than the published starting prices based on project scope, technical requirements, custom functionality, development complexity, negotiated pricing, or other relevant considerations.
Commissions are calculated exclusively on the Eligible Development Fees actually collected by XTX Creative LLC, regardless of the project’s classification or published starting price.
XTX Creative LLC retains sole authority to determine project classifications, establish development fees, negotiate pricing, and prepare client proposals. Exclusive Partners have no authority to guarantee pricing, project classifications, or commission amounts.
The definitions and criteria for Standard, Advanced, and Enterprise website development projects are established in Section 4.4.
4.1 Commission Exclusions
Commissions do not apply to:
- Monthly website maintenance, management, or marketing retainers, including monthly Website Care plan fees.
- Search engine optimization services billed separately from website development.
- Google Ads, Meta Ads, or other advertising management fees.
- Advertising budgets or media expenditures.
- Website hosting or domain registration fees.
- Software subscriptions, licenses, and third-party services.
- Applicable sales taxes.
- Reimbursable expenses and pass-through charges.
- Future projects, renewals, or additional services purchased after the original Client Agreement, unless separately approved in writing.
Only the initial website development project under the Client Agreement resulting from an Introduction is commissionable.
4.2 Project Scope Changes
If the scope of a project changes before completion, the commission will be calculated using the final Eligible Development Fees actually collected.
Additional development work performed under an approved change order that forms part of the original project will be included in the commission calculation.
Separate projects initiated after completion of the original project are not automatically eligible for additional commissions.
4.3 Pricing Adjustments and Discounts
Commissions are calculated on the Eligible Development Fees actually collected after any discounts, promotional offers, negotiated reductions, or other pricing adjustments. Commissions are not calculated using published, standard, or originally quoted fees unless those amounts are actually collected.
XTX Creative LLC retains sole discretion over all project pricing, discounts, and negotiations. Exclusive Partners are not authorized to offer discounts, modify pricing, or make financial commitments on behalf of XTX Creative LLC without prior written authorization.
4.4 Website Development Project Classifications
For purposes of this Agreement, XTX Creative LLC classifies website development projects into three general categories: Standard, Advanced, and Enterprise. These classifications reflect the anticipated scope, technical complexity, development requirements, and project management responsibilities associated with each engagement.
a. Standard Website Development
Standard Website Development generally includes the design and development of a professional, informational website intended to present a business, organization, its services, and related content.
These projects typically involve conventional website functionality, standard content management capabilities, and a clearly defined scope of work completed within a single development phase.
Standard projects generally do not include e-commerce functionality, extensive custom application development, or complex third-party integrations.
b. Advanced Website Development
Advanced Website Development generally includes websites requiring functionality, technical implementation, or development complexity beyond a conventional informational website.
These projects may include e-commerce functionality, advanced content management requirements, specialized website features, custom integrations, or other technically complex development work.
Advanced projects typically have a clearly defined scope of work and are completed within a single primary development phase.
c. Enterprise Website Development
Enterprise Website Development generally includes large-scale or highly complex website projects requiring extensive planning, coordination, technical development, or project management.
These projects may involve multiple stakeholders, multiple development phases, extensive custom functionality, complex integrations, or significant coordination between the Company and the client.
Enterprise classification reflects the overall complexity and management requirements of the engagement rather than any single website feature.
d. Classification Authority
XTX Creative LLC retains sole and exclusive authority to evaluate, classify, and price all website development projects.
Project classification shall be determined by the Company based on the overall scope of work, technical requirements, anticipated development effort, project management responsibilities, and other relevant considerations.
The inclusion of any particular feature, functionality, or service does not automatically qualify a project for a specific development classification.
Exclusive Partners are not authorized to classify prospective projects, guarantee project classifications, or represent that a prospective client qualifies for a particular development tier.
e. Relationship to Commissions
Project classifications are provided for informational and administrative purposes and do not establish guaranteed project fees or commission amounts.
Commissions are calculated at the applicable commission rate based on the Eligible Development Fees actually collected, regardless of the project’s classification, subject to Sections 4.1 through 4.3.
5. INTRODUCTIONS & SUCCESSFUL REFERRALS
5.1 Making an Introduction
Exclusive Partners must make Introductions in writing using a method described in Section 2 or otherwise designated by XTX Creative LLC. Each Introduction should include:
- The prospective client’s name.
- Business or organization name.
- Contact information.
- A brief description of the prospective project.
- Confirmation that the prospective client has authorized the Introduction.
5.2 Eligible Introductions
An Introduction is eligible for commission only if:
- The prospective client authorized the Introduction or the sharing of their contact information with XTX Creative.
- The prospective client is not already a current XTX Creative client, an active sales prospect, or a business previously introduced by another referral source, unless the Company provides written authorization.
XTX Creative LLC will notify the Exclusive Partner within 14 calendar days after receiving an Introduction if the prospective client is ineligible under this section. If no such notice is given, the Introduction is treated as eligible.
5.3 Successful Referrals
An Introduction becomes a Successful Referral when the prospective client and XTX Creative LLC sign a Client Agreement within 180 calendar days after the date of the Introduction.
If no Client Agreement is signed within 180 days, the Introduction expires unless XTX Creative LLC provides a written extension. An expired Introduction may be made again, subject to Section 5.2 and any intervening Introductions by others.
A Successful Referral is counted on the date the Client Agreement is signed by both the client and XTX Creative LLC.
5.4 Duplicate Introductions
If more than one person introduces the same prospective client, XTX Creative LLC will recognize the first eligible Introduction received in writing. Only one commission may be paid for any project.
5.5 Qualified Introductions
An Introduction becomes a Qualified Introduction when both of the following are true:
- The Introduction is eligible under Section 5.2.
- The prospective client’s owner or another authorized decision-maker completes an Initial Consultation with XTX Creative within 30 calendar days after the date of the Introduction.
XTX Creative LLC will offer the prospective client an Initial Consultation within 14 calendar days after receiving an eligible Introduction. If XTX Creative LLC does not offer an Initial Consultation within that time, the Introduction is treated as a Qualified Introduction.
An Introduction does not become a Qualified Introduction if the prospective client declines, fails to schedule, or does not attend an Initial Consultation within the 30-day period.
A Qualified Introduction does not need to result in a Client Agreement. Whether the prospective client signs, and whether XTX Creative LLC accepts the project, has no effect on whether the Introduction is a Qualified Introduction. Every Successful Referral is also a Qualified Introduction.
6. COMMISSION ELIGIBILITY & PAYMENT
A commission becomes payable when all of the following conditions have been satisfied:
- The Introduction has become a Successful Referral.
- XTX Creative LLC has collected Eligible Development Fees under the Client Agreement.
- The collected payments have cleared and are not subject to a pending refund, reversal, or chargeback.
- The Exclusive Partner has provided a completed IRS Form W-9 (or other tax documentation reasonably required by the Company).
- The Exclusive Partner has complied with the applicable provisions of this Agreement.
6.1 Payment Schedule & Installments
Website development fees may be collected in a single payment or in installments, such as a deposit and a final payment.
Commissions are paid in proportion to each installment. The Exclusive Partner will receive the applicable commission on each payment of Eligible Development Fees within 15 business days after that payment is received and cleared by XTX Creative LLC.
Commissions will not be paid on outstanding invoices, unpaid balances, or amounts that are subsequently refunded or reversed.
6.2 Canceled Projects
If a project is canceled or terminated before completion, the commission is based only on Eligible Development Fees actually collected and retained by XTX Creative LLC. No commission is payable on refunded amounts.
The Company may delay commission payment while a cancellation, refund, chargeback, or payment dispute remains unresolved. Any commission owed will be paid within 15 business days after the matter is resolved.
6.3 Commission Adjustments
If a commission has already been paid and the underlying payment is refunded, reversed, or charged back within 180 days after XTX Creative LLC received it, the Company may seek reimbursement of the corresponding commission or offset that amount against future commissions, to the extent permitted by law.
6.4 Taxes
Exclusive Partners are responsible for providing accurate payment details and for applicable taxes arising from commissions received through the Program. The Company may issue tax reporting forms as required by law.
7. ACTIVITY REQUIREMENT
The XTX Exclusive Partner Program is intended for individuals and businesses that actively introduce new clients to XTX Creative.
Each Exclusive Partner must make at least one Qualified Introduction in every Activity Period. This requirement applies to all Exclusive Partners equally, regardless of how long they have participated in the Program or how many Qualified Introductions they made in earlier periods.
Exclusive Partners are not required to produce paying clients to remain in the Program. Whether a prospective client signs a Client Agreement does not affect the activity requirement.
A Qualified Introduction counts toward the Activity Period in which the Introduction was made, even if the Initial Consultation takes place in the following Activity Period. Qualified Introductions do not carry over from one Activity Period to the next.
If an Exclusive Partner does not make a Qualified Introduction during an Activity Period, the Exclusive Partner will be reclassified into the XTX Referral Program effective on the first day after that Activity Period ends.
If an Introduction made during an Activity Period is still within its 30-day Initial Consultation window when the period ends, and it is the Exclusive Partner’s only Introduction in that period, reclassification is held until that window closes. If the Introduction becomes a Qualified Introduction, the Exclusive Partner remains in the Program. If it does not, reclassification takes effect when the window closes.
This requirement is firm. XTX Creative LLC will not grant exceptions, extensions, or grace periods beyond those stated in this Section.
XTX Creative LLC will send the Exclusive Partner written notice of reclassification. Reclassification takes effect as stated above whether or not, or whenever, the notice is received.
8. RECLASSIFICATION TO THE XTX REFERRAL PROGRAM
Failure to satisfy the activity requirement in Section 7 does not result in complete termination of the referral relationship. Instead, the Exclusive Partner will be reclassified from the XTX Exclusive Partner Program to the XTX Referral Program.
8.1 Effects of Reclassification
Upon reclassification:
- The Exclusive Partner’s Exclusive Partner status ends.
- The Exclusive Partner transitions to the XTX Referral Program, subject to its applicable Terms & Conditions.
- The commission rate changes from 20% to 10% for Introductions made on or after the reclassification date. Introductions made before that date are governed by Section 8.3.
- The activity requirement in Section 7 no longer applies.
- The vacated Exclusive Partner position becomes available to another prospective Exclusive Partner.
- The Exclusive Partner may continue introducing prospective clients to XTX Creative and earning commissions through the XTX Referral Program.
Reclassification is an administrative change in participation status and is not considered termination of the overall referral relationship.
8.2 Protection of Earlier Successful Referrals
Successful Referrals with Client Agreements signed while the Exclusive Partner held Exclusive Partner status retain the 20% commission rate, even if the Exclusive Partner is later reclassified. Those commissions remain subject to the payment conditions of this Agreement.
Reclassification does not retroactively reduce or cancel commissions on those Successful Referrals.
8.3 Introductions Pending at Reclassification
If an Introduction made while the Exclusive Partner held Exclusive Partner status results in a Client Agreement signed after the reclassification date, but within the 180-day period in Section 5.3:
- The commission on that Successful Referral is paid at the 20% Exclusive Partner rate.
- The Exclusive Partner is eligible for reinstatement to the XTX Exclusive Partner Program if their former position has not been filled. If the Exclusive Partner elects reinstatement by written notice within 30 calendar days after the Client Agreement is signed, the Exclusive Partner is reinstated under this Agreement, and a new Activity Period begins on the date the Client Agreement was signed.
- If the former position has already been filled, the Exclusive Partner remains in the XTX Referral Program, but the 20% rate still applies to that Successful Referral.
This section does not extend or create an exception to the activity requirement in Section 7. Reclassification still takes effect at the end of the Activity Period as stated there.
Commissions from the two programs may not be combined.
8.4 Reinstatement
Apart from Section 8.3, a former Exclusive Partner may be invited to rejoin the XTX Exclusive Partner Program. Reinstatement under this section is subject to:
- An available position within the limit of 12 Exclusive Partners.
- Approval by XTX Creative LLC.
- Signing the Program Terms & Conditions in effect at the time of reinstatement.
Reinstatement under this section is not automatic. An Exclusive Partner reinstated under this section begins a new Activity Period on the Execution Date of the new agreement.
9. EXCLUSIVE PARTNER RESPONSIBILITIES & PROFESSIONAL CONDUCT
Exclusive Partners agree to:
- Represent XTX Creative accurately and professionally.
- Make Introductions only with the prospective client’s knowledge and authorization.
- Provide truthful information regarding prospective clients and their project needs.
- Avoid misleading statements regarding the Company’s services, capabilities, pricing, or expected results.
- Respect confidential business information.
- Comply with applicable advertising, privacy, and anti-spam laws.
- Disclose their financial referral relationship when required by applicable law or professional rules.
Exclusive Partners may not:
- Enter into agreements on behalf of XTX Creative LLC.
- Negotiate or guarantee pricing, deliverables, or project timelines.
- Promise specific search rankings, advertising performance, or financial results.
- Collect payments from prospective clients on the Company’s behalf.
- Represent themselves as employees, owners, or authorized agents of XTX Creative LLC.
- Use XTX Creative’s branding in paid advertising without written authorization.
- Resell, subcontract, or white-label the Company’s services through the Program.
All project proposals, pricing decisions, Client Agreements, and development services remain under XTX Creative LLC’s direct control.
10. INDEPENDENT STATUS — NOT AN EMPLOYEE OR SUBCONTRACTOR
Exclusive Partners participate solely as independent referral sources. Exclusive Partners are not employees, subcontractors, agents, or representatives of XTX Creative LLC. Exclusive Partners do not perform website design, website development, marketing, or any other client services for or on behalf of XTX Creative LLC, and XTX Creative LLC does not engage Exclusive Partners to perform work of any kind. The only compensation an Exclusive Partner receives under this Agreement is the referral commission described in Section 4.
Nothing in this Agreement creates an employment relationship, subcontracting relationship, legal partnership, joint venture, franchise, agency relationship, or other relationship granting authority to act on behalf of XTX Creative LLC.
Exclusive Partners are not entitled to wages, salary, employee benefits, insurance, workers’ compensation, unemployment benefits, or reimbursement of expenses from XTX Creative LLC. XTX Creative LLC does not withhold income or payroll taxes from commissions.
Exclusive Partners control their own time, methods, and business activities, and are responsible for their own business expenses, taxes, and legal obligations. Neither party may bind the other to contractual or financial obligations.
Participation does not require XTX Creative LLC to provide reciprocal referrals, purchase services from the Exclusive Partner, or enter into any other commercial relationship with the Exclusive Partner.
11. PROGRAM EXCLUSIVITY & CAPACITY
The XTX Exclusive Partner Program is limited to 12 active participants.
This limit applies to Program membership only and does not provide Exclusive Partners with exclusive geographic territories, industries, customer categories, or referral rights.
Exclusive Partners may maintain other professional relationships, provided they comply with the obligations established in this Agreement.
XTX Creative LLC may independently market its services, pursue new business opportunities, and operate its separate XTX Referral Program.
Reclassification of an Exclusive Partner makes the vacated position available for another prospective Exclusive Partner.
12. RELATIONSHIP TO THE XTX REFERRAL PROGRAM
XTX Creative LLC operates two separate referral programs.
XTX Referral Program
- Open to eligible individuals and businesses.
- 10% commission on Eligible Development Fees.
- No activity requirement.
- No limit on the number of participants.
XTX Exclusive Partner Program
- Invitation-only participation.
- Limited to 12 active Exclusive Partners.
- 20% commission on Eligible Development Fees.
- At least one Qualified Introduction required in every six-month Activity Period. Introductions do not need to result in a paying client.
- Reclassification to the XTX Referral Program at the end of any Activity Period without a Qualified Introduction.
- 20% rate honored on Introductions made while an Exclusive Partner, even if the client signs after reclassification.
A Successful Referral may qualify under only one program. The applicable commission rate is determined by the Exclusive Partner’s program status on the date of the Introduction.
Commissions may not be stacked, combined, or transferred between programs.
13. CLIENT ACCEPTANCE & PROJECT DISCRETION
XTX Creative LLC retains sole authority to evaluate prospective clients and determine whether to enter into a Client Agreement.
An Introduction does not guarantee that the Company will enter into a Client Agreement with the prospective client.
The Company may decline projects for legitimate business reasons, including:
- Inadequate project preparation.
- Undefined or frequently changing business objectives.
- Insufficient financial resources.
- Unreasonable deadlines or expectations.
- Technical requirements outside the Company’s capabilities or availability.
- Excessive project-management demands.
- Conflicts of interest.
- Other circumstances that make the project commercially or operationally unsuitable.
Exclusive Partners are not entitled to commissions on declined projects or Introductions that do not result in collected Eligible Development Fees. A Qualified Introduction still counts toward the activity requirement in Section 7 even if the Company declines the project or no Client Agreement results.
14. CONFIDENTIALITY & PRIVACY
Exclusive Partners may receive limited nonpublic information relating to XTX Creative LLC’s business operations, services, prospective clients, or referral activity.
Exclusive Partners agree not to disclose, distribute, or misuse confidential information obtained through Program participation.
Exclusive Partners must obtain appropriate authorization before sharing prospective clients’ personal or business contact information.
The Company will use referral information for legitimate business purposes associated with evaluating and communicating with prospective clients, consistent with applicable privacy laws and its published Privacy Policy.
Confidentiality obligations survive reclassification or termination.
15. PROGRAM MODIFICATIONS
XTX Creative LLC may modify Program terms, eligibility requirements, commission rates, or administrative procedures by providing Exclusive Partners with at least 30 calendar days’ written notice. Changes will apply prospectively.
Introductions made before a modification’s effective date remain subject to the commission terms in effect when the Introduction was made.
Updates to Schedule A do not require notice and do not affect commissions on Client Agreements already signed.
Material changes may require Exclusive Partners to sign updated Terms & Conditions to continue participating.
16. SUSPENSION & TERMINATION
Either party may terminate participation in the Program by providing written notice.
XTX Creative LLC may immediately suspend or terminate participation for material violations of this Agreement, fraud, misrepresentation, unlawful conduct, or misuse of confidential information.
Inactivity alone does not constitute grounds for complete removal from XTX Creative’s referral network. Inactivity is addressed through reclassification under Sections 7 and 8.
16.1 Commissions Following Termination
If participation ends for reasons other than fraud, material misconduct, or material breach, Introductions made before the termination date remain eligible for commission during their 180-day period under Section 5.3, and commissions on them remain payable under this Agreement.
Nothing in this section permits forfeiture of commissions that must be paid under applicable law.
16.2 Effect of Termination
Upon termination, the Exclusive Partner must discontinue representing themselves as an active XTX Creative Exclusive Partner.
If the Exclusive Partner has been reclassified rather than terminated, they may continue participating in the XTX Referral Program under its applicable terms.
Sections concerning earned commissions, independent status, confidentiality, taxes, liability, notices, and dispute resolution survive termination to the extent necessary to enforce their provisions.
17. NO GUARANTEE OF EARNINGS
Participation does not guarantee minimum earnings, Client Agreements, commission payments, or any particular volume of referral opportunities.
XTX Creative LLC does not guarantee that any Introduction will result in a Client Agreement or paid project.
Exclusive Partners acknowledge that commission earnings depend on Successful Referrals and completed commercial transactions.
18. LIMITATION OF LIABILITY
To the maximum extent permitted by applicable law, neither party shall be liable to the other for indirect, incidental, consequential, special, or punitive damages arising from participation in the Program.
Nothing in this Agreement limits liability that cannot legally be excluded or restricted.
19. GOVERNING LAW & DISPUTE RESOLUTION
This Agreement shall be governed by, interpreted, and enforced in accordance with the laws of the State of Texas, without regard to its conflict-of-law principles.
Any dispute, controversy, or claim arising out of or relating to this Agreement, the XTX Exclusive Partner Program, referral commissions, or the relationship between XTX Creative LLC and an Exclusive Partner shall be resolved exclusively in Dallas County, Texas.
The parties irrevocably consent to the exclusive jurisdiction and venue of the state courts located in Dallas County, Texas, or, where federal jurisdiction exists, the United States District Court for the Northern District of Texas, Dallas Division.
Each party waives any objection to such jurisdiction or venue, including objections based on inconvenient forum, to the fullest extent permitted by applicable law.
In any action to enforce this Agreement, the prevailing party is entitled to recover its reasonable attorney’s fees and costs.
Nothing in this section shall prevent either party from seeking relief in a different court where otherwise required by applicable law.
20. ENTIRE AGREEMENT & SEVERABILITY
This Agreement, including Schedule A, constitutes the entire understanding between XTX Creative LLC and the Exclusive Partner concerning participation in the XTX Exclusive Partner Program.
Any amendment must be documented in writing and signed by XTX Creative LLC. No amendment or waiver may change the activity requirement in Section 7 for an individual Exclusive Partner.
If any provision is found invalid or unenforceable, the remaining provisions will continue in effect to the extent permitted by law.
Failure to enforce a provision on one occasion does not waive the right to enforce it subsequently.
21. NOTICES
Written notice under this Agreement may be given by email. Notices to the Exclusive Partner will be sent to the email address listed in the signed Agreement, or a replacement address the Exclusive Partner provides in writing. Notices to XTX Creative LLC must be sent to the Company’s designated program email address.
A notice sent by email is considered received on the business day after it is sent, unless the sender receives notice that delivery failed.
22. ACCEPTANCE OF TERMS
Participation in the XTX Exclusive Partner Program requires a signed copy of this Agreement. By signing it, the Exclusive Partner acknowledges that they have read, understood, and agreed to this Agreement, including the activity requirement in Section 7. The date of the last signature is the Execution Date.
These terms are published here for reference. The signed Agreement controls if it differs from this page. Questions about these terms can be sent to chris@xtxcreative.com.
SCHEDULE A — STARTING WEBSITE DEVELOPMENT FEES
The amounts below are current starting development fees and illustrative commissions only. They do not constitute guaranteed project prices, minimum commissions, or maximum earning limits. XTX Creative LLC may update this schedule at any time.
| Development Tier | Starting Website Development Fee | Partner Commission (20%) |
|---|---|---|
| Standard Website | $2,500 | $500 |
| Advanced Website | $5,000 | $1,000 |
| Enterprise Website | $7,500 | $1,500 |
Installment example: On a $5,000 Advanced Website paid as a $2,500 deposit and a $2,500 final payment, the Exclusive Partner receives $500 after the deposit clears and $500 after the final payment clears.
